Penal Code 1203.4 (a) In any case in which a defendant has fulfilled the conditions of probation for the entire period of probation, or has been discharged prior to the termination of the period of probation, or in any other case in which a court, in its discretion and the interests of justice, determines that a defendant should be grated the relief available under this section.
Instructions for Preparing Expungements
All paperwork must be typed, as these are legal documents. The court will not charge you a fee to file your petition; however, a fee may be charged at the time the judicial officers makes a decision on your petition.
The petition to Withdraw Plea must be completed with an original and two copies. Any research needed to complete the form should be done prior to the time of filing.
At the time of filing, the court will require a self addressed stamped envelope if you wish to receive a copy of the Order of Dismissal, if and when the Judge signs it.
Please be advised that pursuant to Penal Code section 1203.4 this order does not relieve the defendant of the obligation to disclose the conviction in response to any direct question contained in any questionnaire of application for public office or for licensure by any state or local agency.
The process does not seal your record.
