Continue / Drop / Reserve Procedure

Documentation must be submitted to the clerk’s office by 10:00 a.m. the day before the first scheduled hearing.

Request for Order/ Order to Show Cause (FL-300)
Continuances and drops require a confirming letter (stating both parties agree) that may be faxed. No fee required.

Settlement & Trial Confirming Conferences, Short Cause & Long Cause Trials
Continuances require a confirming letter (stating both parties agree) that may be faxed. No fee required. The letter must specifically state that each hearing will be vacated, and the parties would like to reset a Trial Setting Case Management Conference heard, in Dept. 31, 8:30 AM on any Friday. Parties can pick any Friday, but it must be stated in the confirming letter.
Drops require a confirming letter (stating both parties agree) that may be faxed. No fee required. The confirming letter must state that each hearing related to the trial will be vacated.

TAC – Trial Assignment Conference (Also known as, Trial Setting Conference)
To continue or vacate require a confirming letter (stating both parties agree) that may be faxed. No fee required.

Emergency Request Hearings
Cannot be continued.
Drops require a confirming letter that may be faxed. If the party was properly noticed, the letter must state both parties agree. No fee required.

Documentation must be submitted to the clerk’s by mail, drop box or the filing counter.

Order to Show Cause - Contempt
Continuances and drops require a stipulation and order. A fee for filing a stipulation and order is required. Check fee schedule for the appropriate fee amount. You may not submit your filings by fax.

Order to Show Cause – DV/TRO
Continuances: The party requesting the continuance must file forms DV-115, Request to Continue Court Hearing and DV-116, Order on Request to Continue Hearing. No fee required.
Can not be dropped without a court appearance. You may not submit your filings by fax.

Reserved Hearings:
Requesting party must file the Request for Order, form FL-300 (or other moving paper) with the court at least 30 days prior to the hearing by mail, drop box or at the front counter along with the appropriate filing fees. Filings may not be submitted by fax.

Documentation accepted by fax need not be followed up with the original. The submitting party will keep the original documentation. [CRC 2.305 (a) and (b)].
