Continue / Drop Procedure

Request for Order

Continuances and drops require a confirming letter, (both parties must agree) that may be faxed, no fee required.
Documentation must be received by the clerk's office, by noon, the day before the first scheduled hearing.

Order to Show Cause - DV/TRO

Cannot be dropped without a court appearance.  Continuances after service, require a stipulation and order and must state, "Court orders any and all orders and restraining order previously made in this case remain in full force and effect pending the next hearing date."  Continuances due to protective party unable to serve restrained party, require a Reissuance (FL-306).
Documentation must be received by the clerk's office, by noon, the day before the first scheduled hearing.

Settlement & Trial Confirming Conferences, Short Cause & Long Cause Trials

Continuances require a confirming letter (both parties must agree) that may be faxed, no fee required.  The letter must specifically state that each hearing will be vacated, and the parties would like to reset a Trial Setting Case Management Conference heard, in Dept. 31, 8:30 am on any Friday.  Parties can pick any Friday, but it must be stated in the confirming letter.
Drops require a confirming letter (both parties must agree) that may be faxed, no fee required.  The confirming letter must state that each hearing will be dropped.
Documentation must be received by the clerk's office, by noon, the day before the first scheduled hearing.

TSCMC - Trial Setting Case Management Conference

Continuances and drops require a confirming letter (both parties must agree) that may be faxed, no fee required.
Documentation must be received by the clerk's office, by noon, the day before the first scheduled hearing.

CMC - Case Management Conference

Cannot be continued or dropped.

Ex Parte

Standing Order for Ex Parte and OST

Cannot be continued.  Drops require a letter that may be faxed, no fee required.

*   Documentation accepted by fax need not be followed up with the original.  The original documentation to be kept by the submitting party. [CRC 2.305 (a) and (b)].
